Building regulations on the beach

I managed to get an answer from the “Municipalidad de Sta Cruz” based on a beachfront lot we have for sale about 300 meters before Hotel Capitan Suizo.  We asked for an “Uso del Suelo” for this  vacant  lot,  located on the beach of Playa Tamarindo and within the “Zona Maritimo Terestre”. It is a lot with “Escritura” or a so called Titled land or “area privada en la zona maritimo terrestre”. We have asked for the possibility to build on it and what the restrictions are in terms of height, setback and density. The answer was a letter explaining that there is currently no “Plano Regulador” in place in this area and it will depend on which of  the 3 different possible zoning`s like  1. residential, 2. tourism and accommodation or 3. commercial and services will apply for this area.   In short  the maximum height for all 3 zones will be 16 meters (52.5 feet).  Maximum footprint coverage of construction is 60-65% of the lot size, and set backs between 3 to 5 meters. The rest of the land on the beach within the 200m “Zona Maritimo Terrestre”  which is called “concesion” will have a maximum of 14 meters and 3 stories as recently announced by La Gaceta.
